You agree to the following when selecting "Customer Agreement" on the listing.
Safety Guidelines
Our products should always be fun but being prepared will help keep it fun. We do not want you to die. Seriously, Anything over your head or face is inherently risky. You could really die if you don’t take precautions we suggest here. So, Listen up! Failure to use good judgment, not having a Supervisor and not following these safety guidelines can result in serious injury or death.
By purchasing, gifting and/or using this product you are aware of the risk involved and voluntarily take on all risk, damages and results in not following safety guidelines which can result in discomfort, damage, injury or death.

I have watched the Safety Video and understand the safety information and inherent risk of using these products.

I understand and agree this product must never be worn while under the influence of drugs or alcohol.

I understand when wearing this product, I should ALWAYS do so with someone else around, especially if it inhibits breathing.

I understand that failure to use good judgement, not having a Supervisor, and not following these safety guidelines can result in serious injury or death.

I understand and agree that my supervisor should always have a sharp, pointy pair of scissors or box cutter to cut me out in case of an emergency.
When using our product, you MUST have someone watching you.
Hint: Bring a retractable box cutter (a ceramic cutter won't rust) in one hand to cut yourself out in case of an emergency while your supervisor has a pair of scissors for safety. Practice using the cutter. If the product you received from us is made of PVC, practice by wrapping an old PVC pool toy over your hand with cutter in hand.

If the product you received from us is made of latex, practice using an old latex garment or latex gloves. Practice extending the blade and cutting through the material. You need to know what it takes to cut through.
Nonverbal Emergency Signal
When having anything over your head or face, make sure to establish and practice a nonverbal emergency signal with your supervisor in case you need to escape. A wireless doorbell (available for about $20 on Amazon) is a good idea to indicate distress. Put the button into a zip-lock bag to protect it from sweat and have it in your other hand so you can press to indicate distress. 
Always test your verbal and non-verbal signals with your partner before beginning play.
Shipping and Tracking
Once the item leaves Candy Coated, they are no longer responsible for the item in transit.
By purchasing I understand that once the item leaves Candy Coated, they are no longer responsible for the item in transit. I do not hold Candy Coated responsible for damages or loss of purchase during transit.

I recognize that Candy Coated is not responsible for any damages that occur during shipping, Customs, or delivery. Any damage that does occur is solely my responsibility and I do not hold Candy Coated liable for repairs.

I understand that orders may take 2-4 business days to ship from the time a shipping label is created. 

I understand and agree that any items that are shipped, unless otherwise communicated and acknowledged by Candy Coated, will be sent to the address provided at checkout.

Candy Coated is able to adjust shipping addresses should my location change before my purchase has shipped. I understand and agree that I am responsible for any shipping balances that may occur due to the change.
Warranty
Warranty Disclaimer: Save to the extent required by applicable law, CCK does not accept any fiduciary duty to you. You access and use our Etsy Store or website, purchase the Products and use the Products at your own risk. CCK assumes no liability or responsibility for any: - errors, mistakes, or inaccuracies of design that was not pointed out before making (including premade), - personal injury, property damage or death, of any nature whatsoever, resulting from your access to and use of our products, - any unauthorized access to or use of our servers and/or any content, including Content, personal information and/or financial information, stored therein, - a gift for someone else where they use it that could results in personal injury or death upon receiving and using products produced by CCK, - Underage, whether supervised or unsupervised, usage that results in personal injury, property damage or death, of any nature whatsoever, resulting from their access to and use of our products, does not warrant, endorse, recommend, guarantee, or assume responsibility for any product or services advertised or offered by a third party through the Website, the Services or any hyperlinked website or featured in any user submission or other advertising, and CCK will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. The above disclaimer does not affect legal rights which cannot be excluded under applicable law.
Purchasing
By purchasing I understand and agree that products sold by Candy Coated are intended for people 18 years of age and older.

No Children Under the Age of 18- The Site and the CCK Services are not intended for children under 18 years of age. We do not sell products for purchase by/for children and products we sell must be purchased by adults. We do not knowingly collect personal information from children under 18.

If you are under 19, do not use or provide any information on this Site or through the CCK Services.

I understand that in purchasing this item there may be patches on the material upon receiving it. I understand that this is normal and expected for PVC and latex items. Patches are due to reinforcing weak spots and to prevent tearing. I understand and agree that I will not request a replacement solely due to visible patches.

By purchasing this item, I recognize that proper usage and care is required to maintain the material’s integrity.

I understand that the following can damage the product:
  • Over-inflation (can tear seams)
  • Being too rough with the product (can tear seams)
  • For suits, inflating while the zipper is open (ends of zipper can break causing the suit to tear)
  • For suits, pulling on the two sides of the open zipper (end of zipper can tear)
  • Using the product on rough surfaces (material can form abrasions)
  • Using the product in hot temperatures or direct sunlight (can cause glue on seams to come undone)
  • Using inappropriate lubricants or lack of cleaning as described in CCK's Care Instructions.
Permissions
By purchasing, I give my full permission to Candy Coated Kink to use all forms of media (photos, videos, etc.) of my order taken by CCK for business promotion on all social medias, websites, etc. and will not hold CCK responsible for any comments or messages left regarding the product. Photos, videos, etc. may be taken by CCK during creation and testing before being sent to the customer, and CCK will not share photos and videos that the customer posts on social media without express permission from the customer.
Please note: CCK will not ever reveal any identifying customer information.

I understand that if I am asking Candy Coated to build a custom suit for me that if the suit is designed after a character or object that is protected under a copyright, that it is my responsibility to license the design from the original owner. 
Policies
Warranty- If An Item Is Incorrect
If a customer receives an item that has been incorrectly made (e.g., missing components, incorrect sizing, etc.), they must contact Candy Coated within 45 days of the original shipment date. It is the customer’s responsibility to notify Candy Coated as promptly as possible. After the 45-day period has elapsed, the customer will be financially responsible for any necessary adjustments or remakes.
Return Policy
Due to the nature of our products, returns are not accepted for most products. 
Refund Policy
Due to the nature of our products, all sales are final. No cancellations of orders or cash refunds are available. Items are created on a made-to-order basis, so production has already been paid and we cannot cancel with your order with production.

Shipping Policy
Candy Coated does its best to send purchases in the most secure way possible. We now offer multiple shipping carrier options.

That said, once an item leaves the Candy Coated location it is no longer in our control. Items being sent internationally can take up to 3 months to arrive, depending on the location and Customs.

Should an item be lost in transit, Candy Coated is not responsible for a free replacement but will do what we can to find your lost package and get your original purchase to you. 
Return Shipping/Storage Policy
Customer has up to one month to pay any remaining balance and return shipping from the date a Candy Coated member informs the customer the work is completed. After one month, a storage fee of $10/week will be added to the balance until the entire balance is paid. This storage fee may be altered should the customer contact Candy Coated regarding a payment plan.
Chargeback Policy
We kindly ask that you contact us before filing a chargeback, as initiating one without first reaching out goes against our store policy.

If a chargeback is filed without attempting resolution, the order may be canceled and future purchases may be restricted.
Service Policy
Any service (repair, reinforcement, chlorination or ATBC service) provided by Candy Coated is at the company's discretion.
For the safety of our team, any item that is sent for said service must be cleaned thoroughly- removing all lubes, lotions, bodily fluids, etc. Should (an) item(s) arrive dirty, Candy Coated reserves the right to charge an hourly cleaning fee or refuse service and return the item(s) at the customer's expense.
Right to Cancel Order
Candy Coated reserves the right to cancel an order at any time. Reasons for this may include, but are not limited to: the inability to complete an order as previously planned, hostile communication from the customer, refusal or inaction of signing the Customer Agreement.

Should an order be cancelled, the customer will receive a refund for the item purchased.
Right to Refuse Service
Candy Coated reserves the right to refuse service to anyone who is hostile, aggressive, abusive, underage, whom we feel is a danger to our employees or themselves, or shows signs of harassment or intimidation toward our employees or others.
Privacy Policy
Your privacy is very important to us. We want you to understand the type of information we collect when you visit our site and how we use this information. 
Log File Data
In common with other websites, log files are stored on the web server saving details such as your IP address, browser type, referring page and time of visit. This information is not used to track individual visitors to this website.
Cookies & Your Personal Data
Candy Coated uses data collected by cookies and JavaScript libraries to improve your shopping experience. As the customer, you have the ability to manage what information is collected. Simply scroll to the bottom of the webpage and select “Manage Website Data Collection Preferences”
Privacy of Your Information
All information collected is used solely for the purposes of Candy Coated. These purposes include requesting additional information for the customer’s order, shipping, and occasional emails. We won't share your personal information with anyone else except when required by some third-party services who provide services such as sending out promotional emails.
Design Copyright
I understand that if I am asking Candy Coated to build a custom suit for me that if the suit is designed after a character or object that is protected under a copyright, that it is my responsibility to license the design from the original owner.
